📚 Florida Law: What You Need to Know
Name changes in Florida are governed by Florida Statutes §68.07, which outlines the requirements for both adult and minor petitions.
Adult Name Changes
Under §68.07, adults must:
-
Be at least 18 years old
-
Undergo fingerprinting and a criminal background check through FDLE
-
Swear under oath that the name change is not for fraudulent or unlawful purposes
-
Not be a convicted felon, unless their civil rights have been restored
Minor Name Changes
Also filed under §68.07 but require:
-
Filing by a parent or guardian
-
Consent of both parents, or
-
Legal service and notice to the non-consenting parent
If one parent objects, the court will decide based on the child's best interests.
❌ When a Name Change May Be Denied
Florida courts can deny a name change if:
-
The petition is filed with false or misleading information
-
The petitioner is seeking to avoid debt, criminal liability, or legal obligations
-
The petitioner is a felon without restored civil rights
-
In a child's case, the court finds the change is not in the child's best interests
-
Proper notice is not given to the other parent in a minor child case
🛠️ Step-by-Step Process
Here's how the name change process works with our firm:
1. Conflict Check
Before you can hire us, we are required to complete a conflict check. This ensures we're ethically permitted to represent you. No consultation is required unless you want one.
2. Sign Flat Fee Agreement & Pay
If no conflict exists, we'll send you a service agreement and secure payment link to move forward.
3. Complete Intake & Upload Docs
You'll fill out a short intake form and upload your supporting documents (e.g., ID, birth certificate).
4. We Draft & File Your Petition
We prepare the legal petition and file it with the appropriate court.
5. Fingerprinting (Adults Only)
You'll be sent to a fingerprinting facility to complete a required FDLE background check.
6. Hearing is Scheduled
Once the background check is complete (or the petition is ready), we'll secure a hearing — usually via Zoom. One of our attorneys will appear with you.
7. Final Judgment is Signed
We'll help you obtain certified copies and, if applicable, update your birth certificate, Social Security, driver's license, and more.
⚖️ Contested Child Name Changes
If the other parent:
-
Cannot be located
-
Will not provide consent
-
Files a legal objection
Then the case is considered contested and no longer qualifies for a flat fee. These cases require:
A custom flat fee quote after reviewing your facts, or A $3,500 retainer, billed hourly under our standard family law rates We'll advise you after intake if your case qualifies as contested.
