Is your divorce case too complicated for pro se mediation?

Ending a marriage is never easy, and most people dread the possibility of a courtroom battle, especially if there are significant assets involved.

However, if you are facing divorce, you may have heard about pro se mediation. Would this option work for you and your soon-to-be-ex, or are your circumstances too complicated for this approach?

About pro se mediation

The term “pro se” comes from Latin and means “on one’s own behalf.” You and your spouse would work together, outside of court and the purview of a judge, to create a divorce settlement that is satisfactory to you both. Because the two of you will have control over the many aspects of your divorce, you will probably find, like so many other couples, that there is no need to return to court in the future to handle matters that should have been resolved during the divorce process.

The job of the mediator

A mediator is a neutral third party trained to assist with dispute resolution. There are many benefits to working with such a professional. The mediator will facilitate communication between the two of you, help to clarify issues, introduce alternatives to solving problems, provide information of a legal nature and maintain a civil and cooperative atmosphere.

Reaping benefits

Mediation is much more economical than litigation, which, because it may last for many months or even years, can be extremely expensive. Mediation is also a much faster process. Best of all, it takes place in a nonadversarial setting and provides the foundation for respectful, amicable post-divorce communication, which is especially important if you are still in the process of raising children.

Looking forward

No divorce proceeding is too complicated to settle through mediation. Outside professionals such as an accountant, a financial planner or an appraiser can assist if necessary. Throughout the process, a trained mediator will offer legal guidance. Given its many advantages, pro se mediation may be your best alternative to litigation.
