"Do I Need a Criminal Defense Attorney?"

Most people charged with misdemeanors (or even some felonies) wonder whether they really need to spend the money to hire a criminal defense attorney. Oftentimes during an initial consultation, people feel as though they've heard everything they need in regards to their case and can pretty much handle it on their own. Unfortunately, most times, they would be wrong.

First, there are many options that could be available to you that you may not be aware of, or you may lose should you do certain things. For example, although you may be initially eligible for a state diversion program in Broward County, should you ask to transfer the case out of one of the satellite courthouses and to the central courthouse, you are no longer eligible. Unless you are familiar with the rules specific to each county, you would never become aware of that.

Second, the judge or prosecutor assigned to your case may offer you what seems to be a "good deal" but actually is not. There could be many repercussions that are not readily apparent. For example, if you are adjudicated/convicted on ANY criminal offense (including simple traffic offenses), you will never be eligible to seal or expunge your record.  In addition, what the actual disposition is on your case may not be clear. You may hear "no jail" and "no probation" and immediately accept, and not realize you are being convicted.

Lastly, an experienced criminal defense attorney can spot weaknesses in your case either based on an initial consultation or sometimes after reviewing discovery and speaking with witnesses. Oftentimes this can result in a complete dismissal of the case or a significantly reduced plea offer. The reputation of the attorney plus his/her relationships with judges and prosecutors can also assist in a smoother, fairer process. Most prosecutors will not speak with a defendant so attempting to negotiate a plea deal or offering mitigating factors may fall on deaf ears.
